Fees for service of civil process are regulated by the Government Code. The Sheriff is entitled to his fee for service of process whether or not service is successful (Ref. Government Code 26736 & 26738). The Court Services Division does not accept personal checks for civil process fees. Cash, cashier's check, or money order must accompany requests for services.The Sheriff's Civil Division requires a copy of the Certified Order of Waiver of Fees when the court has waived the Sheriff's fees.
Levy deposits are estimates of costs based upon the combination of statutory fees and anticipated expenses related to performing a particular type of levy. Additional deposits may be required in order to offset expenses related to the handling of inventory, moving, safekeeping of property and conducting execution sales. A deposit, sufficient to pay the costs of seizing and storing property, is a prerequisite to the performance of any levy by the Sheriff's Civil Bureau. The Sheriff's statutory fees and expenses related to the enforcement of a money judgment will increase the total amount to satisfy the judgment. Any portion of the creditor's deposit that is not actually used will be refunded to the judgment creditor within a reasonable time after completion of all enforcement efforts. When the original writ is returned to the court, the Sheriff must prepare an accounting (writ return) crediting all partial satisfactions and added costs.
Regular working hours for our sworn and non-sworn staff are not adjusted for the purpose of initiating or monitoring levies beyond our usual office hours. Sworn deputy sheriffs are required to be available to respond to handle any problem that might arise during the course of any on-going levy (such as a keeper levy at the judgment debtor's business). Generally, overtime is not authorized for our deputies to enforce process originating from civil litigation. However, on a voluntary basis, deputies may work "extra duty hours", being compensated by funds other than from regular salaries. Extra duty hourly rates and vehicle mileage rates are regulated by the Riverside Sheriff's Department and approved by the Riverside County Board of Supervisors. IF YOU WISH TO AVOID THESE ADDITIONAL EXPENSES, you may (in writing) authorize the Sheriff to conduct the levy during the civil bureau's normal office hours and to stop the levy, at such time, so as to avoid any additional expenses.
